the problem is - once you drag and drop there, especially with different condition than AND (like OR) this is irritating.

see screenshot how an actual OR of 2 states is done now.

suggestion: rename to 'root' node, or similar.

I don't really see an issue here - the toplevel is always AND.
If I change it to root and you add another condition 'host name = "blob"' on the same level than your 'OR' group, it's

hostname = "blob" AND (status = 0 OR status = 1)

As the first level is always an AND conjunction, I don't really see any reason why to name it different.
